Abstract:From a jurisprudential perspective, administrative compensation litigation should adhere to the principle of consistency between claims and judgments, not only because of the general requirements of administrative litigation but also due to its unique characteristices in litigation purposes, trial objects, and the relationship between judicial and administrative powers. However, in judicial practice, cases demonstrating inconsistency often fail to consider the features, and neglect plaintiffs’ legitimate demands, consequently undermining parties’ rights while causing procedural inefficiency and judicail resource wastage, which should be rectified. To achieve claim-judgment consistency, it is necessary to clarify the conditions of prosecution, adhere to the adjudication principle of judgment-by-claim, and rationally choose judgment modaities tailored to such litigation.
