Abstract:This paper makes a comparative analysis of the maternity leave system in Guangdong, Hong Kong and Macao from three aspects: the length of maternity leave, pay for maternity leave, and legal liability for violations of relevant laws and regulations on maternity leave. It is recommended that China’s mainland learn from the mature legislative technology and legislative achievements of Hong Kong and Macau, appropriately reduce the statutory maternity leave, cancel the local family planning rewards, reasonably design the maternity leave pay, and increase the punishment for illegal infringement of female employees’ rights and interests in maternity leave, so as to perfect and improve the maternity leave legal system in China’s mainland , realize the docking with international rules, and provide long-term and stable legal guarantee for the construction of the Guangdong-Hong Kong-Macao Greater Bay Area.
