Abstract:In the implementation of administrative interview, it falls into the predicament of “vacancy”, “offside” and lack of actual effect. There are low level of legist ration and some other defects in the system. Administrative interview should be defined as an informal administrative act in administrative factual act, and the types of administrative interview may be divided into normal administrative interview and dissimilated administrative interview. The normal administrative interview includes the administrative guidance interview and the administrative mediation interview. The alienation administrative interview includes the administrative command interview and the administrative punishment interview. The regulations on administrative interview should be formulated for the uniform legislation, taking“interview according to Law”as the basic principle. The scope of application of administrative interview is determined by three criteria: the boundary of government functions, the illegal situation of the interviewees and the relationship with other administrative acts. Country should build a procedural system that can guarantee the rights of the interviewees and the public to know and participate and the effectiveness and efficiency of administrative interviews. Administrative order-type interview, administrative punishment-type interview and regulatory administrative guidance-type interview should be fallen into the scope of administrative relief.
