In the practice of execution, the lawyer’s investigation order not only helps to reduce the pressure of the court in handling cases, to mobilize the enthusiasm of the executor and lawyers to participate in the execution, and to protect the right of participation, the right to know and the right of supervision of the person applying for execution. However, in the process of applying the lawyer’s investigation order, there have been many problems such as repeated rejection, low success rate of investigation and lack of punishment measures for refusing investigation. The main reasons for these problems are firstly the existence of legal vacuum, secondly, the imperfect linkage publicity mechanism, and finally, the lack of standardization of lawyer investigation orders. In order to improve the system of the lawyer’s investigation order, first of all, we should amend the law so that there are laws to follow for the lawyer’s investigation order in the execution stage. Secondly, we should strengthen the linkage, so that the lawyer’s investigation order in the execution phase will not be rejected any more. Thirdly, we should unify the provisions, let the lawyer investigation order in the execution stage“go out in a standard way”, and finally, we should strengthen the establishment of supporting measures to make the execution phase of the lawyer investigation order“operate smoothly”.
