It is necessary for the police power to be restricted reasonably in the process of governing the country according to law in an allround way. However, correction is sometimes inevitably excessive in practice, due to excessive emphasis on the police power restrictions and neglect of protection, resulting in the limitation of police power. It mainly manifests as: the allocation of police power is not exactly forwardlooking, the operation of police power shorts of the system guarantee, and the police power is influenced by the deterioration of external environment, etc. Therefore, the protection of police power is also necessary. The legal principle basis for guaranteeing police power is that police power comes from the legal nature of the state power, that the legal attribute of the police power implies its own safeguard function, and that police power is the cornerstone to maintain order and stability. In view of the dilemma of police power guarantee, it is proposed that the police power should be optimized by speeding up the optimization of police power allocation, the relevant safeguard system of police power operation should be perfected, the coordination power of the legal relationship between the police and the people consolidated, and the guarantee of police power promoted to meet the requirements of social development, to ensure that police can protect civil rights in a more effective manner.
