Recently some scholars thought the scope of special recidivist should continue to expand. But the reasons supporting these viewpoints were not convincing. The expansion theory of special recidivist does not only lack enough legal legitimacy, but also lack the necessity of criminal policy. The legislation tendence of special recidivist should be restricted in the future.
