Abstract:To the problem whether the close relatives, guardians can become the subject of crime or not, the practitioners of criminal law have an affirmative view. But in theory there are absolute negative, relative negative and affirmative three views. In fact, more or less all the three views have defects. To the poor families whose means of survival is begging, if the close relatives, guardians force their disabled and children to beg by means of mild violence or coercion, they are not committing a crime but have committed a minor illegal act.
