| 构建全国统一大市场是实行社会主义市场经济的必然要求，实现有效市场和有为政府的良性互动则需要运用法治手段摆脱地方保护主义和市场垄断分割对要素资源流动造成的不良影响。自中共十四大确定建立社会主义市场经济体制以来，“全国统一大市场”就多次被提及，但是实践中这一系列政策却往往收效甚微。在宪法维度下对央地关系的认识不足和处理不当是造成统一市场构建困难的重要原因之一。要使统一大市场的政策真正得以落实，就必须深入挖掘其中的宪法意涵，认真分析政策实施过程中应然和实然的宪法问题，为“全国统一大市场”提供根本法治保障。 |

| The construction of a unified national market is an inevitable requirement for the implementation of a socialist market economy, and the realization of a positive interaction between an effective market and responsible government requires the application of the rule of law to get rid of the adverse effects caused by local protectionism and market monopoly division on the flow of resources. Since the 14th National Congress of the Communist Party of China decided to establish a socialist market economic system, the idea of “a unified national market” has been mentioned for many times. However in practice, a series of such policies often have little effect. The lack of a constitutional understanding and handling on the relationship between the central and the local governments is one of the main reasons for the difficulties in constructing the unified market. Therefore, in order to implement the policy of unifying the large market, it’s necessary to dig deeper into the constitutional implications of the policy, carefully analyze the de jure or de facto constitutional issues in the process of implementing the policy, and provide the fundamental legal safeguard for the “unified national market”. |
